1. Introduction

Welcome to Nextap ("the App"), an NFC-based professional networking application that allows users to create digital profiles, pair NFC cards, and connect with other professionals. By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Acceptance of Terms

By creating an account and using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and Nextap.

3. Account Registration and Security

3.1. Account Creation

• You must be at least 18 years old to use the App
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to notify us immediately of any unauthorized use of your account

3.2. Authentication

• The App uses email-based OTP (One-Time Password) authentication
• You are responsible for the security of the email address associated with your account
• OTP codes are valid for a limited time and should not be shared with others

4. User Responsibilities

4.1. Profile Information

• You agree to provide accurate and truthful information in your profile
• You are responsible for all content you post on your profile
• You must not impersonate any person or entity
• You must not use the App for any illegal or unauthorized purpose

4.2. NFC Cards

• You may only pair NFC cards that you own or have authorized access to
• You are responsible for the security of your paired NFC cards
• Nextap is not responsible for lost or stolen NFC cards
• You agree to unpair cards that are no longer in your possession

4.3. Connections and Interactions

• You agree to use the App for professional networking purposes only
• You must not harass, abuse, or harm other users
• You must respect the privacy and boundaries of other users
• Connections can be removed at any time by either party

5. Content and Intellectual Property

5.1. Your Content

• You retain ownership of the content you post on your profile
• You grant Nextap a non-exclusive, worldwide license to use, display, and distribute your content for the purpose of operating the App
• You represent and warrant that you have the right to post such content

5.2. Nextap Content

• The App, including its design, text, graphics, and code, is owned by Nextap
• You may not copy, modify, or distribute any part of the App without permission

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand how we collect, use, and protect your personal information.

7. Termination

7.1. By You

• You may terminate your account at any time by using the sign-out feature in the App
• Upon termination, your profile will be removed from public view

7.2. By Nextap

• Nextap reserves the right to suspend or terminate your account if you violate these Terms
• Nextap may also terminate accounts that have been inactive for an extended period

8. Disclaimers and Limitations of Liability

8.1. Disclaimer

• The App is provided on an "as is" and "as available" basis
• Nextap makes no warranties, express or implied, regarding the App

8.2. Limitation of Liability

• To the maximum extent permitted by law, Nextap shall not be liable for any indirect, incidental, special, or consequential damages
• Nextap is not responsible for the actions or content of other users

9. Indemnification

You agree to indemnify and hold Nextap harmless from any claims arising from your use of the App or your violation of these Terms.

10. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Nextap is established, without regard to its conflict of law provisions.

11. Changes to Terms

Nextap reserves the right to modify these Terms at any time. We will notify users of material changes via the App or email. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
