1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the nextap.id website, mobile application, NFC cards, and related services (collectively, the "Service") operated by nextap.id ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account at support@nextap.id.

4. The Service

nextap.id provides:

  • NFC-enabled physical cards (PVC Standard, Metal VIP, Metal Ultra) that link to your digital profile.
  • A mobile application to create, manage, and share your digital business card.
  • A web platform that displays your public profile when your NFC card is scanned by someone without the app.
  • A connection system that facilitates mutual professional networking.

5. NFC Cards & Orders

a) Ordering

By placing an order for an NFC card, you agree to pay the applicable fees as displayed at the time of purchase. All prices are displayed in the applicable currency and include VAT where required by law.

b) Delivery

We will make reasonable efforts to deliver your NFC card within the estimated delivery timeframe. Delivery times are estimates and not guarantees.

c) Right of Withdrawal (EU Consumer Rights)

Under EU consumer protection law, you have the right to withdraw from your purchase within 14 days of receiving your NFC card, without giving any reason. To exercise this right, contact us at support@nextap.id with your order details.

The right of withdrawal does not apply to personalized or customized cards that have been manufactured to your specifications.

d) Refunds

Upon valid withdrawal, we will reimburse all payments received, including standard delivery costs, within 14 days. Refunds will be made using the same payment method used for the original transaction.

6. User Content & Public Profiles

  • You retain ownership of any content you upload to your profile (photos, text, links).
  • By creating a public profile, you grant us a non-exclusive, worldwide license to display your profile content to anyone who scans your NFC card or accesses your card link.
  • You are solely responsible for the accuracy and legality of your profile content.
  • You must not upload content that is illegal, defamatory, harassing, or infringes on any third party's rights.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Impersonate another person or entity
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated means (bots, scrapers) to access the Service without our written permission
  • Upload viruses, malware, or other malicious code
  • Reproduce, duplicate, or resell any part of the Service without authorization

8. Intellectual Property

The Service, including its design, code, branding, logos, and content (excluding user-generated content), is owned by nextap.id and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

9. Subscription & Recurring Payments

If the Service includes subscription-based features, the following applies:

  • Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
  • You may cancel your subscription at any time through the app or by contacting us.
  • Cancellation takes effect at the end of the current billing period. No partial refunds are provided for the remaining period.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not guarantee that the Service will be uninterrupted, error-free, or secure.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total aggregate liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable EU law.

11. Termination

  • You may terminate your account at any time by deleting it through the app or contacting us.
  • We may suspend or terminate your access if you violate these Terms, with reasonable notice where possible.
  • Upon termination, your public profile will no longer be accessible, and your NFC card will be deactivated.

12. Dispute Resolution

We encourage you to contact us first at support@nextap.id to resolve any disputes amicably.

If a dispute cannot be resolved informally, it shall be subject to the jurisdiction of the courts in the country of our registered office, without prejudice to your rights as a consumer to bring proceedings in the courts of your habitual residence under EU Regulation 1215/2012.

As an EU consumer, you may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national law of our registered office, without regard to conflict of law provisions. If you are a consumer in the EU, you also benefit from any mandatory provisions of the law of the country in which you reside.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
